This CA98 Guidance describes how we will exercise our concurrent competition enforcement powers in respect of the prohibitions in Chapter I and Chapter II of the Competition Act 1998 (CA98) and/or Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU). It sets out the procedures that we will follow in investigating and taking enforcement action against suspected anti-competitive agreements and abuses of a dominant position in relation to participation in payment systems in the UK. This guidance has been issued under section 52 CA98.
We state in our CA98 guidance that we expect leniency applications to be made directly to the Competition and Markets Authority (CMA). We have agreed with other concurrent regulators that the CMA should act as a single port of call for all leniency applications.
